PanicSwap — Terms and Conditions

1. Acceptance of Terms

By accessing or using PanicSwap, including our website, application, connected wallet features, monitoring tools, alerts, and any related services (collectively, the “Service”), provided by PanicSwap (“Provider,” “we,” “us,” or “our”), you (“User,” “you,” or “your”) agree to these Terms and Conditions (“Terms”). If you do not agree, do not use the Service.

2. Service Description

PanicSwap provides tools that help users monitor Solana tokens, assess risk, and automate protective actions (e.g., emergency sell/swap) based on user-defined rules. Features can include real‑time alerts, automated risk detection (e.g., rug‑pull signals), portfolio monitoring, and optional automated execution on supported DEXes. Availability of features may vary by plan and region.

3. Eligibility and Accounts

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use the Service. You are responsible for safeguarding your wallet, private keys, and any authentication methods. All activity originating from your wallet or account is your responsibility.

4. Fees, Payment, and Subscriptions

  • Subscription Fees: Certain features require a paid subscription as shown in the app’s pricing. Fees are typically denominated in SOL and billed on a recurring basis (e.g., monthly), unless otherwise stated.
  • Payment: You agree to pay applicable Fees for the plan you select. Payments are processed on Solana or via designated processors. Ensure your wallet has sufficient funds.
  • Renewal: Subscriptions renew automatically at the end of each billing cycle unless you cancel before renewal.
  • Fee Changes: We may change Fees with reasonable notice (in‑app, email, or website). Continued use after the change means you accept the new Fees.

5. Refund Policy

  • 3‑Day Refund Window: We offer a full refund of your initial subscription payment if requested within three (3) calendar days of purchase for paid plans (Trader, Pro, Enterprise). Discovery (free) has no payments and is excluded.
  • After 3 Days: All Fees are final. No refunds or credits for partial periods, unused features, plan downgrades, or early cancellation after the initial 3‑day window.
  • How to Request: Contact us via our official Telegram support channel within the 3‑day period.

6. User Conduct

You agree not to use the Service for illegal activity; not to attempt to reverse engineer, attack, or disrupt the Service; not to share access; and not to use the Service to provide financial advice or manage assets for third parties.

7. Intellectual Property

The Service and all associated content, code, designs, and logos are the property of the Provider or its licensors. We grant you a limited, non‑exclusive, revocable license to use the Service per these Terms. No rights to PanicSwap trademarks are granted.

8. Disclaimers

  • No Financial Advice: Information, analysis, alerts, and automations are for informational purposes only and do not constitute financial, investment, or trading advice.
  • DYOR: You are solely responsible for decisions. Consult qualified professionals as needed.
  • No Guarantees: We do not guarantee accuracy, availability, profit, or loss avoidance. Crypto markets are volatile and risky.
  • As‑Is: The Service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind.

9. Limitation of Liability

To the fullest extent permitted by law, the Provider and its affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, data, or goodwill, arising from or relating to your use of the Service. If liability is found, our aggregate liability is limited to the Fees you paid in the three (3) months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless the Provider and its affiliates from claims, losses, and expenses arising from your use of the Service or violation of these Terms.

11. Term and Termination

You may stop using the Service at any time. We may suspend or terminate access for any reason, including non‑payment or breach. Upon termination, certain sections survive, including 6–10 and 12–14. Except as stated in the Refund Policy, no refunds are issued upon termination.

12. Modifications

We may update these Terms at any time. Material changes will be communicated via the Service or website. Continued use constitutes acceptance of the updated Terms.

13. Governing Law and Disputes

These Terms are governed by applicable laws of the jurisdiction in which the Provider operates. Disputes will be resolved via binding arbitration in English in a venue reasonably designated by the Provider, unless prohibited by law. Seek legal advice to tailor this section for your locale.
